Terms & Conditions (T&C) | Distance-Selling Information

1 · Scope & Contracting Party

These Terms govern every consumer purchase (B2C) made in the Beer of Satoshi online shop (“we,” “us”). 2 · Minimum Age / Youth Protection

Alcohol may only be sold and delivered to persons aged 18 years or older. We use a two-step age-verification procedure (online check at checkout and “Age-Check 18” by the courier upon delivery). If age verification fails or appears falsified, we reserve the right to cancel the order.

3 · Offer, Presale & Contract Formation

1. Product pages are non-binding invitations to order.
2. By clicking “Buy Now” you submit a binding offer (Section 145 BGB).
3. We accept the offer by explicit order-confirmation email.
4. Presale: The Genesis batch (21,000 bottles) is still in production. Shipping starts September 2025.

4 · Force Majeure / Supply Issues

In cases of force majeure (e.g. natural disasters, strikes, unforeseen governmental restrictions) or supply chain disruptions beyond our reasonable control, we are entitled to extend delivery times or cancel orders if necessary. We will inform you promptly about any significant delays.

5 · Prices, VAT & Excise Duties

All prices include VAT according to the destination country (OSS scheme). Beer excise duty is paid in the destination country. Any additional import taxes or duties (outside the EU) are borne by you.

6 · Payment Methods

We accept Credit Cards (Visa / Mastercard), PayPal, and Bitcoin / Lightning (advance payment).

7 · Shipping Area & Costs

We currently ship to Germany and select EU countries listed at checkout. Shipping costs are displayed before the order is placed. Please note these costs are your responsibility; we do not cover them.

8 · Delivery Time & Transport Damage

EU deliveries typically take 1–2 weeks from the start of shipping. Risk of loss only passes on physical receipt (Section 475 (2) BGB). In the event of transport damage, please notify us and the carrier immediately. We will replace or refund accordingly.

9 · Retention of Title

The goods remain our property until full payment is received (Section 449 BGB).

10 · Right of Withdrawal (14 Days)

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day you (or a third party other than the carrier indicated by you) acquires physical possession of the goods.

Exceptions:

• Once a bottle is opened (bottle cap broken), no withdrawal is possible for that item (Section 312g (2) No. 3 BGB, as it is sealed food/beverage).
• Alcoholic beverages to be delivered more than 30 days after conclusion and whose price depends on market fluctuations (Article 16(l) Consumer Rights Directive). However, we grant a voluntary 14-day return for unopened bottles after receipt.

11 · Effects of Withdrawal

If you withdraw, we will reimburse all payments received from you, including delivery costs (for the standard delivery option), within 14 days using the same payment method. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier. You bear the direct cost of returning the goods. We may claim compensation for any diminished value resulting from improper handling.

12 · Warranty

Statutory warranty rights apply. Minimum shelf life: approx. 15 months from bottling (see label).

13 · Bottle-Cap Rewards (“Hidden Sats”)

1. Each bottle cap may contain a Lightning QR code worth between 21–1,000,000 sats. Redeem within 12 months of purchase. No Gambling: This random reward is purely promotional, included in the beer purchase price, and does not constitute a separate gambling or lottery activity.
2. Alternatively, you may convert these sats to a shop voucher or donate the value to Bitcoin community projects if offered.
3. Once the bottle cap is opened or the code is redeemed, your right of withdrawal for that bottle is voided.

14 · Liability

We have unlimited liability for intent and gross negligence. For simple negligence, we are liable only in cases of injury to life, body, or health or for breaches of essential contractual obligations (cardinal duties), and then limited to foreseeable, typical damages. We disclaim liability for Bitcoin exchange rate fluctuations or future BTC values.

15 · Online Dispute Resolution

The EU Commission provides an ODR platform: ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in consumer arbitration (Section 36 VSBG).

16 · Governing Law & Jurisdiction

German law applies. Mandatory consumer-protection provisions of your country of residence remain unaffected. For merchants, the place of jurisdiction is Cologne, Germany.

17 · Amendment & Salvatory Clause

We reserve the right to amend these Terms where required (e.g., for legal or technical reasons). Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.

• Invoices & tax records: 10 yrs (AO & HGB)
• Server logs: 14 days, then anonymised
• Analytics & widget cookies: see respective lifetimes or until consent withdrawn

GDPR rights of access, rectification, erasure, restriction, portability and objection. Contact us or lodge a complaint with the DPA NRW (ldi.nrw.de).

7 · Security Measures
